Unfortunately, I do not this is a refusal that is winnable. There is a slight chance that responding will overcome the refusal, but this mark is highly similar to several other marks on the register, and it may be better to rebrand.

Thanks for getting back to me with your honest view on this one, Ryan. We would like to pursue this mark for now, as we believe that there is a case for getting approval for this mark based on prior registration of the same mark well prior to other mentioned marks cited in the response letter.
