OPPOSITION FOR ONE OF OUR APPROVED TRADEMARKS (EMAIL SENT TO SORT OUT THE DIFFERENCES)

Recently, we noticed an opposition for one of our trademarks after it got approved. After seeing this response, it did put us in a spin for some time. Then, we decided to address the issue straight on rather than worrying and/or complaining about it. Moreover, we know the strength of our side and the supporting evidences that we already possess, and those that were presented at the time of the trademark examination process, which led to the approval in the first place. As part of this action-response mode, we decided to reach the opposing party directly to address the issue. Shared below is the content of that email.

Why are we sharing this content to the general public?

Trademark filing, approval and such oppositions are publicly available for everyone to see. Instead of a selected few with vested interests and power getting to see it, we decided to share it to the public for everyone to see. This action, we believe, would further add credibility to actions taken by our organization in offering "lean, clean without being mean" products around the globe.

Respected Madam/Sir:

  This email is with regard to the opposition that we noticed for one of our approved trademarks, VAL-U-PRO CONSULTING GROUP from your end. I totally understand the importance of trademarks in managing our brands, and the plausible reason that might have resulted in your team's decision to oppose our approved trademark.  It is also the reason that I am reaching out to your team directly to resolve any differences and misunderstandings that might be there with respect to this approved trademark.   If interested to further this communication for us to set our differences apart based on the merit of the supporting documents that we offer to provide, please let us know and we would be more than happy to further this dialogue.

I would also like to start this communication with a simple public search result for the mark, "valupro", and you would be able to see in the attached file that this is the only search result that shows up. This result indirectly implies that our mark is unique in its own way. We can offer more detailed explanation to address this issue, which was also presented to the assigned examiner prior to our mark getting approved. However, some of those documents have not been uploaded yet, and is not available in the publicly viewable trademark database, which could also have been the reason for your team to oppose our mark.
