But, if commenting, discussing and any transformative use of videos would fall under transformative fair use, we need to look into details on why and when embedding tweets would be a copyright infringement.

Even with the example of "Monkey Business" of photographs, if Black Macaque taking a selfie picture will not be the same as a photographer processing the photo, and getting primary ownership of photos in the process, embedding tweets while citing the original source, if known, for a transformative use need not be a copyright infringement.

As with any legal proceedings, devil is in the details. We will come with our own analysis soon.
